Rajya Sabha petition cites “proven misbehaviour” under constitutional provisions; row intensifies over voter roll revisions and West Bengal polls

New Delhi, April 24, 2026 — The Opposition has moved a fresh plea to remove Chief Election Commissioner Gyanesh Kumar. A motion signed by 73 MPs have been submitted to the Rajya Sabha.

The Opposition has accused the CEC of partisan conducts in the office. Kumar has piloted the special intensive revision (SIR) in states, which faced major criticism for alleged deletion of voters’ names from the electoral rolls in states.

“…73 Opposition MPs in the Rajya Sabha have just submitted to its Secretary General a fresh Notice of Motion for presenting an Address to the President of India praying for the removal of Shri Gyanesh Kumar, Chief Election Commissioner of India,” wrote Congress MP Jairam Ramesh in a post on X.

Ramesh also stated that the notice has been moved “on the ground of proven misbehaviour constituted by acts and omissions committed on and after 15 March 2026, within the meaning of Article 324 (5) of the Constitution of India read with Article 124(4) thereof, Section 11(2) of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023 and the Judges (Inquiry) Act, 1968. “

“There are now nine specific charges against the CEC that have been documented in great detail and that simply cannot be denied or whitewashed away. His continuation is an assault on the Constitution,” added Ramesh. He added that “it is an absolute disgrace that the man continues to be in office to do the bidding of the PM and HM.”

The Opposition had previously also given a similar notice in the Rajya Sabha. The presiding officer of the upper house of parliament had rejected the motion against the CEC.

Kumar was a secretary in the Ministry of Home Affairs before his appointment in the Election Commission. Kumar had been accused by the Trinamool Congress leaders of acting in a partisan manner in the ongoing Assembly elections in West Bengal.

Kumar has also been facing flaks for his overdrive in micromanaging the transfers of officials in West Bengal. His supporters credit him for the peaceful polling in the phase one in West Bengal.
