Jagdeep Dhankar Slams Judiciary: ‘Judges Acting as Super Parliament’ in Fiery Critique

By Manish Anand

New Delhi, April 17, 2025: Vice President Jagdeep Dhankar on Thursday launched no-holds-barred attacks on the Supreme Court of India. Sharply castigating the judiciary for binding President of India with time-limit to approve bills, Dhankar came down scorching with ringing condemnation of the Supreme Court for no action in the Yashwant Varma “cash scandal”.

“Where are we heading? What is happening in the country,” asked Dhankar as he dwelt on Justice Varma cash scandal case and Supreme Court verdict on Tamil Nadu Bills. He was speaking at a valedictory function for the interns of the Rajya Sabha on Thursday.

“We never bargained for democracy for this day. President being called upon to decide in a time-bound manner and if not, it becomes law,” said Dhankar.

The Vice President in further stinging condemnation of the SC TN Bill verdict said that “so, we have judges who will legislate, who will perform executive functions, who will act as super Parliament and absolutely have no accountability because law of the land does not apply to them”.

Dhankar fired his ammunitions at the apex court by clubbing the SC TN Bill verdict and Justive Varma cash scandal for his undiluted angst. The Vice President said that the judicial functionaries in no “thriving democracies across the world have immunity from investigations”. Dhankar quoted a media survey to lament “dipping faith in the judiciary among the people”.

The Supreme Court had formed a committee to probe the Justice Varma cash scandal while transferring him to the Allahabad High Court.

“A question we must think, there is a committee of three judges investigating the matter (Justice Varma cash scandal) but investigation is domain of the executive. Investigation is not the domain of judiciary. Is the committee under constitution of India,” asked Dhankar, while answering in negative.

“It is now over a month, even if it is can of worms, even if there are skeletons in the cupboard, time to blow up the can … time for the cupboard to collapse. Let the worms and skeletons in public domain so that cleansing takes place,” asserted the Vice President.

Dhankar rued the lack of FIR in the Justice Varma cash scandal case. “No investigation under law is in progress at the moment because for a criminal investigation, the initiation has to be by an FIR. First Information Report. It is not there,” said Dhankar.

Seemingly expressing anger against the apex court for TN Bill verdict, Dhankar said that “Article 142 of the Constitution, which gives the Supreme Court special powers, has become a nuclear missile against democratic forces, available to the judiciary 24×7”.

“I have no doubt parliament cannot script a judgement of a court. Parliament can only legislate and hold institutions including Judiciary and Executive accountable,” said Dhankar.

Singling out the apex court for his sharp attack for usurping powers of executive, the Vice President also said that “there is a principle of accountability in operation. In parliament you can ask questions, critical questions, because the governance is by the executive but if this executive governance is by judiciary, how do you ask questions?”
