Joe Biden has no Faith in US Judiciary, says ex-Diplomat

New Delhi, December 3: US President Joe Biden’s act of pardoning his son, Hunter Biden, has set off an avalanche of commentaries globally. The Hunter Biden pardon is also seen as a precursor of events to come after President-elect Donald Trump assumes power early next month.

“Biden is the first beneficiary of Trump v. U.S,” remarked Jack Goldsmith, Professor at Harward Law School. He argued in a post on X that the incumbent President Joe Biden has immunity from future investigations in pardoning his son for involvement in several crime cases.

Former diplomat Yogesh Gupta said that the “USA today is in crisis”. “Its incumbent president has no faith in judicial system and has pardoned his son, Hunter Biden for committing many violations of laws. Biden says that he does not trust whether the American politics and judiciary would treat his son fairly,” Gupta wrote in a post on Linkedin.

Joe Biden’s pardon of his son going back to 2014 covers Hunters’ Burisma activities. “Whether or not there was criminality, there might have been an investigation by the incoming Trump administration,” added Goldsmith.

He stated that a possible Trump administration probe is now “off the table now (as is Hunter’s 5th Amendment claim before congressional investigators)”. “Also off the table is any Trump administration investigation of Biden for issuing the pardon to obstruct justice, on a theory of obstruction,” added Goldsmith.

He argued that the Hunter Biden pardon is absolute. “(Joe) Biden is protected by the Supreme Court’s July immunity decision from criminal investigation for possible obstruction of justice by the incoming Trump administration. The Court said that a pardon was a conclusive and preclusive presidential power, and that the president’s exercise of such a power is broadly immune from criminalization, investigation, or prosecution by a subsequent administration,” added Goldsmith.

Hunter Biden was involved in getting contracts for oil drilling in Ukraine in lieu of his father’s assistance to the war-ravaged country as per media reports.
“New President Trump has started appointing family members to important positions in his administration. Son in law Cushner’s father has been appointed as Ambassador to France,” Gupta stated on personal interests affecting decisions of the top executive in the US.
Gupta also stated that “American exceptionalism is now dead. We request the USA to now not give any lectures to the rest of the world about the democratic values, free elections, freedom of press as you have none. It is all about profiting from your positions in the government for your family.”
